Terms of Service for Molly

Welcome to Molly! These Terms of Service ("Terms") govern your use of the Molly mobile application and any related services (collectively, the "Service"), provided by Molly Team ("we," "us," "our," or the "Company").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not access or use the Service.

1. Description of Service

Molly is a software application that allows users to upload their personal photographs ("User Images"), apply artistic style filters to them ("Style Transfer"), and save the resulting modified images ("Transformed Images"). The Service may offer both free features and premium features available through an auto-renewable subscription.

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your country to be responsible for your own data) to use the Service. By agreeing to these Terms, you represent and warrant that you meet this age requirement.

3. User Accounts

While some features of the Service may be available without an account, certain functionalities, such as storing and accessing your image history or accessing premium features, may require you to register for an account.

4. User-Generated Content

• Ownership: You retain all ownership rights to your original User Images. Likewise, you own the Transformed Images created from your User Images. We do not claim any ownership over your content.
• License to Us: In order to provide the Service, you grant the Company a limited, non-exclusive, royalty-free, worldwide, revocable license to use, host, store, reproduce, modify, and create derivative works (specifically, the Transformed Images) from your User Images. This license is for the sole purpose of operating, providing, and improving the Service. This license terminates when you delete your User Images or your account.
• Your Responsibility: You are solely responsible for the content you upload. You represent and warrant that you own the User Images or have the necessary rights and permissions to use them.

5. Subscriptions and Payments

Certain features of the Service may be offered on a subscription basis ("Subscription").

• General: If you purchase a Subscription, you will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are typically set on a monthly or annual basis. Your Subscription will automatically renew at the end of each Billing Cycle unless you cancel it.
• Payment: All payments are processed through Apple's App Store and are subject to the App Store's terms and conditions. You must provide a valid payment method to purchase a Subscription. We do not collect or store your payment card details. That information is provided directly to Apple.
• Cancellation: You may cancel your Subscription renewal at any time through your Apple ID account settings. You must cancel at least 24 hours before your Billing Cycle ends to avoid being charged for the next period. The cancellation will take effect the day after the last day of the current subscription period, and you will be downgraded to the free service.
• Refunds: Except when required by law, paid Subscription fees are non-refundable. We are not able to process refunds for purchases made through the App Store. To request a refund, you must contact Apple Support directly.
• Price Changes: We may, at our discretion, modify the Subscription fees. Any fee change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

6. Intellectual Property Rights of the Company

Excluding your User-Generated Content, all aspects of the Service, including the application software, design, text, graphics, logos, underlying technology, and style filters, are the exclusive property of Molly Team and its licensors.

7. User Conduct and Restrictions

You agree not to misuse the Service. You will not reverse engineer, decompile, or discover the source code of the application or its style filters, or use the Service for any commercial purpose without our prior written consent.

8. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

9. Termination

You may terminate these Terms at any time by deleting your account. We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, if you violate these Terms.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. MOLLY TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE SERVICE.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms within the application.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is domiciled, without regard to its conflict of law principles.
